Terms and Conditions
1 Recognition
By placing your order, you acknowledge all points of these general terms and conditions, which apply exclusively. Any contractual terms that deviate from these are not recognized by ATELIER MOMOL KLG. By placing an order, the buyer acknowledges all points of these terms and conditions.
2 Conclusion of contract
All offers are non-binding. If the customer places an oral, written or electronic order for products, he or she makes a binding offer to conclude a purchase contract.
A legally binding purchase contract is concluded with the written or electronic dispatch of the order confirmation by ATELIER MOMOL KLG or delivery. If a product is no longer available or deliverable, ATELIER MOMOL KLG can withdraw from the contract in whole or in part without compensation. Payments already made will be refunded.
ATELIER MOMOL KLG is not obliged to accept orders, especially if the customer has outstanding payments from previous purchases or if his account is subject to debt collection measures. If the customer's outstanding payments are only discovered after the purchase contract has been concluded, ATELIER MOMOL KLG has the right to withdraw from the contract at any time and without any compensation and to invoice for deliveries and services already provided.
3 Prices and payment
Prices are in CHF including VAT. Transport, assembly and packaging costs are not included in the price. ATELIER MOMOL KLG reserves the right to adjust prices and/or make pricing errors at any time. Orders can be paid for by credit card, advance payment or invoice.
4 Dimensions and illustrations etc.
All dimensions, weights, information and images of our products are non-binding. The description, technical information and prices of the products can be changed at any time. Model changes, typographical or graphic errors, errors in the product descriptions, prices and technical information remain reserved.
5 Shipping and delivery
The delivery period begins with the order confirmation. Multiple items from the same order are usually shipped together. For items with different delivery times, the longest applies. The item is shipped via parcel service. Parcels are usually delivered to the first front door, and large and bulky items may be delivered to the curb.
Buildings and locations that are not accessible by car/truck or are difficult to reach (e.g. mountain areas) must be agreed and calculated individually and are excluded from these provisions.
The option of self-collection is available by arrangement from our warehouse in Zurich.
The buyer must notify the transport company and ATELIER MOMOL KLG in writing of any damage caused during transport within 3 days of delivery. In the event of damage, the goods must be kept including the packaging until the case has been resolved and not used. When the goods are handed over, the defects must be noted on the delivery note. After 3 days, the goods are considered to have been delivered in perfect condition.

6 Delivery times
Delivery times are given as accurately as possible. However, these are based on experience and are non-binding. Delivery dates may change under certain circumstances.
In no event shall delays in delivery give rise to claims for damages or a right to withdraw from the contract.
7 Retention of title
The delivered goods remain the property of Atelier Momol KLG until full payment has been made. Legal recourse is excluded.
8 Return
Returns due to damaged or incorrectly delivered goods must be reported to ATELIER MOMOL KLG by email including photos to info@atelier-momol.ch registered and approved by ATELIER MOMOL KLG. They are only possible within 7 days of receipt of the goods. A receipt or copy of the invoice must be enclosed in any case. Items that have been manufactured specifically for the customer are excluded from the right of return. Returns of parcel shipments and freight forwarding goods are at the customer's expense and risk. If the goods are in new condition after they are returned, the value of the goods will be refunded, less any delivery costs already paid.
9 Warranty and liability
Deviations in structure and color are unavoidable for certain materials compared to the specifications and therefore do not entitle the customer to make complaints or warranty claims. In normal cases, no guarantee can be given for the lightfastness of the colors of wood. The guarantee is excluded for damage that is due to normal wear and tear or improper use or other fault of the buyer. The guarantee is also excluded if the customer or third parties have made repairs or modifications to the goods.
ATELIER MOMOL KLG accepts no liability for damage to the building structure (e.g. floor, walls) or to the buyer's furniture caused by the use of the goods. The buyer must ensure before use that the product cannot cause any damage.
If the buyer asserts legitimate defects in writing within the meaning of these provisions, ATELIER MOMOL KLG has the choice of repairing the defects or replacing the defective goods or parts thereof with new ones. The duration of the warranty is not renewed or extended by any repair or replacement delivery. Further claims by the buyer, including lost profits, consequential damages or other financial losses are expressly excluded within the scope of what is legally permissible.

10 changes
ATELIER MOMOL KLG is entitled to change its General Terms and Conditions at any time by notifying the buyer or publishing them on the website.
11 Place of jurisdiction
These General Terms and Conditions are governed by Swiss law, in particular the provisions of the Swiss Code of Obligations.
The place of jurisdiction is the registered office of the provider (CH-8004 Zurich).
